Final Environmental Impact Report certified by San Diego County Department of Environmental Health (DEH) on February 6, 2003. CEQA Findings, Statement of Overriding Considerations and Notice of Determination issued by DEH on June 2, 2004. Revised Final EIR certified on May 31, 2007, with updating EIR addendums adopted in August 2008, January 2010 and May 2010. All prior litigation challenging the adequacy of the environmental analysis has been resolved favorably to the project.
Issuing Agency: California Integrated Waste Management Board/San Diego County Department of Environmental Health
Process: "Filed as incomplete" application dated August 2010. DEH has until February 2011 to make completeness determination. A comprehensive review of the permit application package has been completed by both the project and DEH, and further revisions completed.
On February 1, 2011 the LEA determined that the Solid Waste Facility Permit application package for the proposed Gregory Canyon Landfill, previously accepted as incomplete, is complete and correct.
Issuing Agency: San Diego Regional Water Quality Control Board
Process: Permit application for WDR's deemed complete and correct in March 2005, and tentative WDR's issued for public comment in April 2009. Public comment period expired in July 2009. Board has directed that WDR's and the 401 certification be included in the same action. In light of the new jurisdictional determination by the Army Corps, the 401 application was revised and is under review by RWQCB staff.
Issuing Agency: San Diego County Air Pollution Control District
Process: Final air quality impact report supplement submitted September 2010. The project is fine-tuning some model runs to respond to questions from APCD staff, which will be submitted in January 2011. If all technical concerns are addressed, permit drafting will begin, leading to issuance of the draft permit for public comment and final action by APCD.

Issuing Agencies: Army Corps of Engineers, U.S. Fish & Wildlife Service, State Historic Preservation Office, California Department of Fish & Game, San Diego Regional Water Quality Control Board.
Process: Two actual permits are required - a Clean Water Act Section 404 dredge & fill permit from the Army Corps of Engineers, and the Streambed Alteration Agreement from the California Department of Fish & Game. In light of a new jurisdictional determination by the Corps, an individual 404 permit is required, and the Corps has elected to prepare a full Environmental Impact Statement under NEPA. Site evaluation and other analysis required for preparation of the EIS in nearing completion. A draft EIS is expected to be issued for public comment in Spring/Summer 2010. The 404 permitting process will also include the Endangered Species Act Section 7 consultation with U.S Fish & Wildlife and the National Historic Preservation Act Section 106 consultation with the state historic preservation agency.
The project received a streambed alternation agreement to construct the landfill access road bridge from the California Department of Fish & Game in December 2009. A second SAA will be required for the remainder of the project.
Permits/Approvals: Agreement related to protection or relocation of aqueduct.
Issuing Agency: San Diego County Water Authority.
Process: The agreement is related to protection/relocation of the existing pipelines, and a road crossing over the existing pipelines.

Issuing Agencies: Various departments within San Diego County.
Process: These are highly technical permits, and in some cases are similar in nature to permits issued by other agencies. A substantial amount of technical work is required prior to submittal of permit applications, including detailed design drawings for the bridge and access road. Once submitted, permit process should take about six months.
Issuing Agency: California Department of Transportation
Process: This permit is required for physical access from the landfill access road onto SR 76. This permit is highly technical in nature, and would be required just before commencement of operation. Design-level drawings must be completed as part of the application.
Issuing Agency: California Public Utilities Commission
Process: The Section 851 approval is required to convey SDG&E's fee interest in the existing SDG&E power line right of way to Gregory Canyon, per the agreement between Gregory Canyon and SDG&E. PUC approval may also be required for the relocation of the power line to the new right of way. SDG&E will undertake both permitting processes.
